In case of doubt, the German version shall prevail.<\/p>\n\n<p class=\"wp-block-paragraph\"><strong>\u00a7 1 Scope and Contracting Party<\/strong><br\/><br\/>(1) These General Terms and Conditions apply to all catering services provided by Amrit I GmbH, Bans &amp; Bans GbR, Amrit III GmbH and Amrit IV GmbH (hereinafter \u201cAMRIT\u201d), in particular the provision and delivery of food and beverages, buffets, loaned equipment and service staff.<br\/><br\/>(2) The customer&#8217;s contracting party is the company named in the quotation and on the invoice.<br\/><br\/>(3) For catering services, these terms and conditions take precedence over the AMRIT General Terms and Conditions for Restaurants.<br\/><br\/>(4) Any differing terms and conditions of the customer shall not form part of the contract unless AMRIT expressly agrees to their application in text form.<br\/><br\/>(5) For the purposes of these terms and conditions, a consumer is any natural person who enters into the contract for purposes that are predominantly outside their trade, business or profession (\u00a7 13 of the German Civil Code, BGB). A business customer is anyone who, when entering into the contract, acts in the course of their trade, business or profession (\u00a7 14 BGB).<br\/><br\/><br\/><br\/><strong>\u00a7 2 Quotations and Conclusion of the Contract<\/strong><br\/><br\/>(1) AMRIT&#8217;s quotations are valid for 10 days from the date of issue.<br\/><br\/>(2) The contract is concluded when the customer confirms the quotation in text form. For the purposes of these terms and conditions, text form means text form pursuant to \u00a7 126b BGB, including, in particular, email, letter, fax and scanned documents. Sending an order confirmation by email is legally binding.<br\/><br\/>(3) The contract is also concluded when the customer submits the cost coverage form provided by AMRIT, bearing a stamp and signature. In this case, the customer is entitled to pay against an invoice after the event.<br\/><br\/>(4) Any deviations from these terms and conditions shall be specified separately in the respective quotation.<br\/><br\/><br\/><br\/><strong>\u00a7 3 Provision and Delivery<\/strong><br\/><br\/>(1) Food and beverages shall be made available for collection as agreed or delivered for a separately stated fee.<br\/><br\/>(2) Delivery shall take place at the agreed times. Delays caused by traffic or weather conditions for which AMRIT is not responsible may occur. \u00a7 13 remains unaffected.<br\/><br\/>(3) AMRIT reserves the right to make minor changes to individual food items or beverages that are reasonable for the customer, for example in the event of short-term unavailability. Any substitute shall be of equivalent quality and value.<br\/><br\/><br\/><br\/><strong>\u00a7 4 Prices and Payment<\/strong><br\/><br\/>(1) For business customers, the prices quoted are net prices plus statutory VAT at the applicable rate. For consumers, AMRIT quotes gross prices including VAT.<br\/><br\/>(2) Payment terms are set out in the individual agreement and the invoice.<br\/><br\/>(3) In all other respects, the statutory provisions on late payment apply.<br\/><br\/><br\/><br\/><strong>\u00a7 5 Number of Guests<\/strong><br\/><br\/>(1) The customer shall notify AMRIT in text form of any changes to the number of guests no later than two working days before the start of the event.<br\/><br\/>(2) Billing shall be based on the most recently confirmed number of guests communicated within the required timeframe, even if fewer guests actually attend.<br\/><br\/>(3) Any subsequent changes are possible only by agreement with AMRIT. An increase in the number of guests is subject to availability. AMRIT reserves the right to adjust the price accordingly in either case.<br\/><br\/><br\/><br\/><strong>\u00a7 6 Delivery and Service Fee<\/strong><br\/><br\/>(1) AMRIT charges a flat-rate delivery fee. This covers delivery, buffet setup and collection on the following day.<br\/><br\/>(2) Same-day collection is possible by arrangement and shall be charged separately.<br\/><br\/>(3) The delivery fee covers logistical services only. Services such as serving food, setting tables or attending to guests are not included.<br\/><br\/><br\/><br\/><strong>\u00a7 7 Service Staff<\/strong><br\/><br\/>(1) Service staff can be booked for a minimum of four hours. Additional time shall be charged for each half-hour commenced.<br\/><br\/>(2) The customer shall inform AMRIT of the required staffing times in advance. Any extensions agreed on site shall be charged based on the actual additional time worked.<br\/><br\/>(3) AMRIT recommends one member of service staff for every 30 guests to ensure smooth operations and a consistently high standard of service.<br\/><br\/><br\/><br\/><strong>\u00a7 8 Loaned Equipment<\/strong><br\/><br\/>(1) AMRIT provides the customer with the equipment required for presentation and transport (e.g. trays, platters and bowls) on loan, in some cases for a fee. The loaned equipment remains the property of AMRIT.<br\/><br\/>(2) The customer shall use the loaned equipment only for its intended purpose and shall not pass it on to third parties. All items shall be ready for collection at the agreed time, with food residues removed.<br\/><br\/>(3) After collection, AMRIT shall check the loaned equipment for completeness and condition. The customer shall be liable for damage or loss for which they are responsible, up to the replacement value. The customer shall not be liable for normal wear and tear.<br\/><br\/><br\/><br\/><strong>\u00a7 9 Cancellation<\/strong><br\/><br\/>(1) The customer may cancel a confirmed order in text form. The time at which AMRIT receives the cancellation shall be decisive.<br\/><br\/>(2) In the event of cancellation, AMRIT shall charge the following flat-rate cancellation fees, each based on the agreed order value:<br\/><br\/>\u2013 more than 7 days before the start of the event: free of charge<br\/><br\/>\u2013 7 to 6 days before the start of the event: 20%, with a minimum of \u20ac80.00<br\/><br\/>\u2013 5 to 4 days before the start of the event: 50%, with a minimum of \u20ac150.00<br\/><br\/>\u2013 3 days or fewer before the start of the event: 100%<br\/><br\/>(3) The customer retains the right to prove that AMRIT incurred no loss or a substantially lower loss. AMRIT retains the right to prove that it incurred a higher loss.<br\/><br\/>(4) Separately stated flat-rate planning fees are excluded from paragraph 2 and shall be payable in full to the extent that the planning services have already been provided.<br\/><br\/>(5) In the event of illness or an emergency, AMRIT may offer a goodwill arrangement on a case-by-case basis.<br\/><br\/><br\/><br\/><strong>\u00a7 10 Change of Invoice Recipient<\/strong><br\/><br\/>(1) If an invoice is to be reissued to a different recipient after it has been issued, AMRIT may charge an administration fee of \u20ac35.00. No fee shall apply if the change is made before the invoice is issued.<br\/><br\/>(2) The original customer remains the contracting party and the party liable for payment.<br\/><br\/><br\/><br\/><strong>\u00a7 11 Allergens and Special Dietary Requirements<\/strong><br\/><br\/>(1) AMRIT provides information on allergens subject to mandatory disclosure in the quotation and upon request.<br\/><br\/>(2) The customer shall notify AMRIT in text form of any guest allergies, intolerances or special dietary requirements no later than when confirming the number of guests pursuant to \u00a7 5. Without timely notification, AMRIT cannot guarantee that food will be prepared accordingly.<br\/><br\/>(3) In a shared kitchen, the presence of traces of individual allergens cannot be completely ruled out.<br\/><br\/><br\/><br\/><strong>\u00a7 12 Force Majeure<\/strong><br\/><br\/>(1) If AMRIT is unable to perform its obligations due to force majeure or other unforeseeable circumstances for which AMRIT is not responsible, such as severe weather, orders issued by public authorities or a disruption to the energy supply, AMRIT shall be released from its obligation to perform.<br\/><br\/>(2) Payments already made shall be refunded or, at the customer&#8217;s option, credited towards an alternative date. No further claims shall arise insofar as AMRIT is not responsible for the circumstances.<br\/><br\/><br\/><br\/><strong>\u00a7 13 Liability<\/strong><br\/><br\/>(1) AMRIT shall be liable without limitation for damage resulting from death, bodily injury or damage to health arising from a breach of duty by AMRIT, a legal representative or a person employed to perform its contractual obligations.<br\/><br\/>(2) AMRIT shall be liable without limitation for damage caused by intent or gross negligence on the part of AMRIT, a legal representative or a person employed to perform its contractual obligations.<br\/><br\/>(3) In cases of ordinary negligence, AMRIT shall be liable only for a breach of an essential contractual obligation. An obligation is essential if its fulfilment is necessary for the proper performance of the contract and the customer may ordinarily rely on its fulfilment. In such cases, liability shall be limited to foreseeable damage typical of the contract.<br\/><br\/>(4) In all other cases, liability is excluded.<br\/><br\/>(5) Liability under the German Product Liability Act and under any guarantee expressly assumed by AMRIT remains unaffected.<br\/><br\/><br\/><br\/><strong>\u00a7 14 Data Protection<\/strong><br\/><br\/>AMRIT processes the customer&#8217;s personal data in accordance with the General Data Protection Regulation (GDPR) exclusively for the performance of the contract. Data shall be disclosed to third parties only where necessary for the performance of the contract or required by law. The data shall be deleted as soon as it is no longer required for processing the contract, provided that no statutory retention periods prevent its deletion. Further information is available in the privacy policy on amrit.de.<br\/><br\/><br\/><br\/><strong>\u00a7 15 Right of Withdrawal for Bookings on Specific Dates<\/strong><br\/><br\/>There is no statutory right of withdrawal for contracts for the delivery of food and beverages where a specific date or period is stipulated (\u00a7 312g paragraph 2, no. 9 BGB). The cancellation provisions in \u00a7 9 remain unaffected.<br\/><br\/><br\/><br\/><strong>\u00a7 16 Severability<\/strong><br\/><br\/>If any provision of these General Terms and Conditions is or becomes invalid, the validity of the remaining provisions shall remain unaffected. The invalid provision shall be replaced by the applicable statutory provisions.<br\/><br\/><br\/><br\/><strong>\u00a7 17 Applicable Law and Jurisdiction<\/strong><br\/><br\/>(1) The law of the Federal Republic of Germany shall apply, excluding the United Nations Convention on Contracts for the International Sale of Goods. For consumers, this choice of law applies only insofar as it does not deprive them of the protection afforded by mandatory provisions of the law of the country in which they have their habitual residence.<br\/><br\/>(2) If the customer is a merchant within the meaning of German commercial law, a legal entity under public law or a special fund under public law, the exclusive place of jurisdiction for all disputes arising from the contractual relationship shall be the registered office of the contracting party identified in \u00a7 1 paragraph 2. For consumers, the statutory rules on jurisdiction apply.<br\/><br\/><br\/><br\/><strong>\u00a7 18 Priority of Individual Agreements and Text Form<\/strong><br\/><br\/>(1) Individual agreements shall always take precedence over these General Terms and Conditions (\u00a7 305b BGB).<br\/><br\/>(2) Supplementary agreements and amendments must be made in text form. Paragraph 1 remains unaffected.<br\/><br\/><br\/><br\/><strong>\u00a7 19 Consumer Dispute Resolution<\/strong><br\/><br\/>AMRIT is neither willing nor obliged to participate in dispute resolution proceedings before a consumer arbitration body (\u00a7 36 of the German Consumer Dispute Resolution Act).<br\/><br\/><br\/><br\/>Last updated: October 2026<\/p>\n","protected":false},"excerpt":{"rendered":"<p>AMRIT General Terms and Conditions for Catering Amrit I GmbH \u00b7 Bans &amp;
